1. Who we are

2. Acceptance

By creating an account or using our services you agree to these Terms. If you are using the service on behalf of a company, you represent that you have authority to bind it.

3. Services

We provide an AI-powered B2B lead-conversion platform including AI voice calling, SMS, email outreach, CRM, calendar booking and reporting. Specific features depend on the plan you have purchased.

4. Acceptable use

  • You will only contact leads where you have a lawful basis (consent, legitimate interest, or existing relationship).
  • You will respect Do-Not-Call / Do-Not-Email lists, quiet hours, and opt-out requests.
  • You will not use the platform for spam, fraud, harassment, or any unlawful activity.
  • You are responsible for the accuracy and legality of any content, scripts, or contact data you upload.

5. Fees & billing

Subscription fees are billed monthly in advance in INR via Cashfree. Usage (AI minutes, SMS segments, emails) is billed in arrears at the rates published on the pricing page. Failure to pay may result in suspension.

6. Intellectual property

The platform, software, models, and all related IP are owned by Zeemark. You retain ownership of the data you upload and the content you create. You grant us a limited licence to process your data solely to provide the service.

7. Confidentiality & data protection

We treat customer data as confidential and process it in accordance with applicable data protection laws (DPDP Act 2023, GDPR where applicable). A Data Processing Addendum is available on request.

8. Service availability

We target 99.5% uptime on standard plans and 99.9% on Enterprise (with SLA). We perform planned maintenance with reasonable notice.

9. Liability

To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 3 months prior to the claim. We are not liable for indirect or consequential losses.

10. Termination

You may cancel anytime from the billing page; access continues until the end of the paid period. We may suspend or terminate accounts that breach these Terms.

11. Governing law

These Terms are governed by the laws of India. Courts at Bengaluru, Karnataka have exclusive jurisdiction.
